Please read these Terms and Conditions ("Terms," "T&Cs") carefully before using the www.ucube.ai website (the "Service") operated by uCube AI, a service of THIRTY SEVEN UCUBE TECHNOLOGIES PRIVATE LIMITED ("us," "we," or "our"). By accessing or using the Service, you agree to be bound by these Terms.

1. The Service and Account

The Service provides AI-driven software. Users must be over 18 years of age to use the Service. You are solely responsible for all activity that occurs under your account and for maintaining the security of your account credentials.

2. Intellectual Property (IP) Rights

A. Our IP

The Service, its original content, features, and functionality (including but not limited to all software, interfaces, text, graphics, and logos) are and will remain the exclusive property of uCube AI and its licensors. Our IP is protected by copyright, trademark, and other laws of both India and foreign countries.

B. User Input and Output

You retain ownership of User Input (the data, text, or content you submit to the Service). uCube AI grants you a license to the Output (the content generated by the AI in response to your input). You agree that uCube AI may use the User Input and Output, in anonymized and aggregated form, to train and improve its AI models.

3. Usage Restrictions and Acceptable Use

Prohibited uses include, but are not limited to: engaging in illegal activity; infringement of any intellectual property rights; system abuse, including introducing viruses or denial-of-service attacks; and generating hateful, discriminatory, or violent content. You agree to use the Service only for purposes that are lawful and compliant with these Terms.

4. Termination

We may terminate or suspend your account access immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms. Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service.

5. Limitation of Liability

In no event shall uCube AI, nor its parent company (THIRTY SEVEN UCUBE TECHNOLOGIES PRIVATE LIMITED), directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, punitive, exemplary, or consequential damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage.

6. Disclaimer of Warranties

Your use of the Service is at your sole risk. The Service is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance. We do not guarantee that the Service will be error-free, uninterrupted, or secure, or that the AI Output will be accurate, reliable, or suitable for any purpose.

7. Governing Law and Jurisdiction

These Terms shall be governed and construed in accordance with the laws of India, without regard to its conflict of law provisions. You irrevocably agree to submit to the exclusive jurisdiction of the courts located in Bengaluru, Karnataka, India for the resolution of any disputes.

8. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
